These Terms of Service (“Terms”) govern your access to and use of jamai.dev and the websites, applications, artificial intelligence features, flashcard tools, study tools, and related products and services provided by jamAI (“jamAI,” “we,” “us,” or “our”), collectively referred to as the “Service.”

Please read these Terms carefully.

By creating an account, accessing the Service, purchasing a subscription, or otherwise using jamAI, you agree to these Terms.

If you do not agree to these Terms, do not use the Service.

Our Privacy Policy describes how we collect and process personal information and forms an important part of your relationship with jamAI.

1. The jamAI Service

jamAI provides tools designed to help users create, generate, organize, study, and share flashcards and related educational materials.

Features may include:

Import and export functionality; and

Other educational and productivity features.

Some described features may not yet be available.

We may add, modify, limit, or discontinue features as jamAI develops.

Certain functionality may only be available under particular subscription plans.


2. Eligibility

You must be at least 13 years old to use jamAI.

If you are under the age of majority where you live, you represent that you have the permission of your parent or legal guardian to use the Service where such permission is required.

jamAI is not intended for children under 13.

By using the Service, you represent that:

You meet the applicable minimum-age requirements;

You have the legal capacity to agree to these Terms or have any legally required permission from a parent or guardian; and

Your use of jamAI does not violate applicable law.


3. Your Account

Certain jamAI functionality requires an account.

You agree to provide accurate information when creating an account and to keep that information reasonably current.

You are responsible for:

Activity occurring through your account; and

Promptly notifying us of suspected unauthorized access.

You may not:

Impersonate another person; or

Create accounts using unauthorized automated methods.

You may be able to create or access your account using email/password authentication or third-party authentication services such as Google.

Third-party authentication services may also be governed by the provider’s terms.


4. User Content

“User Content” means materials that you create, upload, submit, store, transmit, or otherwise provide through jamAI.

User Content may include:

Answers; and

Other educational or study materials.


5. Ownership of Your Content

As between you and jamAI, you retain your ownership rights in User Content that you own.

Uploading or creating User Content through jamAI does not transfer ownership of your original content to jamAI.

You remain responsible for User Content you provide and for ensuring that your use of that content complies with applicable law and these Terms.


6. License You Give jamAI

To operate the Service, jamAI needs permission to process User Content.

You grant jamAI a non-exclusive, worldwide, royalty-free license to host, store, reproduce, transmit, process, modify, format, display, and otherwise use User Content to the extent reasonably necessary to:

Troubleshoot the Service; and

Operate necessary backup and infrastructure systems.

For example, this license allows jamAI to transmit relevant portions of study material to an AI provider when you request AI-generated flashcards.

This license does not transfer ownership of your User Content to jamAI.

The license ends when the relevant User Content is deleted from the Service, except to the extent:

Retention is reasonably necessary for security or dispute resolution; or

Content has been independently copied by other users after you made it public.


7. Your Responsibilities for User Content

You represent and warrant that you have the rights, permissions, licenses, or other lawful basis necessary to submit your User Content and permit jamAI to process it as described in these Terms.

You may not submit or make available User Content in a manner that:

Unlawfully discloses another person’s confidential information; or

Otherwise violates these Terms.


8. Copyrighted Educational Materials

jamAI is designed in part to help users transform study materials into flashcards.

Study materials may be protected by copyright or other intellectual-property rights.

Materials may include:

Audio recordings; and

Other copyrighted works.

The fact that jamAI can technically process material does not mean you necessarily have the legal right to upload, reproduce, distribute, or publicly share it.

You are responsible for determining whether you have sufficient rights, permission, or another lawful basis to use material through jamAI.

Private processing and public distribution can raise different legal considerations.

You should therefore be particularly careful before making decks derived from third-party copyrighted material publicly available.

jamAI may remove or restrict content that we reasonably believe violates intellectual-property rights or applicable law.

Accounts of repeat infringers may be restricted or terminated where appropriate.

9. AI Features

jamAI uses artificial intelligence to provide certain functionality.

When you use AI features, relevant User Content may be processed by jamAI and transmitted to third-party AI service providers.

jamAI currently uses the Google Gemini API for certain AI functionality.

By requesting an AI-powered operation, you authorize jamAI to process and transmit information reasonably necessary to perform that request.

AI providers and models may change over time.


10. AI-Generated Content Can Be Wrong

Artificial intelligence systems are probabilistic and may produce incorrect results.

AI-generated content may be inaccurate, incomplete, outdated, misleading, incorrectly interpreted, or entirely wrong.

AI may:

Produce outdated information; or

Fail to recognize important context.

You are responsible for reviewing AI-generated flashcards and other output before relying on them.

You should verify important information against reliable and authoritative sources.

jamAI does not guarantee:

Suitability for a particular examination; or

That generated output accurately represents the source material.


11. Educational Purposes

jamAI is an educational and productivity tool.

The Service is not a substitute for:

Qualified professionals; or

Independent verification of important information.

jamAI does not guarantee any particular:

Certification result; or

Professional outcome.

You remain responsible for your own study and academic decisions.


12. Medical and Professional Information

Users may use jamAI to study subjects such as:

Engineering; and

Other professional fields.

jamAI and AI-generated content are provided for educational and informational purposes only.

jamAI does not provide medical, dental, legal, financial, psychological, or other professional advice.

Do not rely on jamAI as the sole basis for:

Providing financial advice; or

Making another professional decision requiring qualified judgment.

Professional information should be verified against authoritative sources and applied using appropriate professional judgment.


13. Public and Private Decks

jamAI may allow you to designate decks or other content as public or private.

Private Content

Content designated as private is not intended to be displayed through jamAI’s public-sharing functionality unless you change its visibility or intentionally share it.

Public Content

When you make content public, you authorize jamAI to display and distribute that content through the Service according to the sharing functionality available.

Public content may:

Be copied by other users; and

Potentially be indexed by search engines.

You are responsible for ensuring you have the right to make content public.

If you later make content private or delete it, copies previously obtained by other people may remain outside jamAI’s control.


14. Acceptable Use

You agree not to misuse jamAI.

You may not use the Service to:

Reverse engineer the Service except where applicable law prohibits such a restriction; or

Assist another person in engaging in prohibited conduct.

We may use technical measures to enforce these restrictions.


15. Academic Integrity

jamAI is intended to support learning.

Schools, universities, professors, testing organizations, and other institutions may have their own rules regarding artificial intelligence and outside assistance.

You are responsible for complying with those rules.

You may not use jamAI in a manner that violates applicable:

Course rules; or

Institutional requirements.

jamAI does not determine whether a particular use of AI is permitted for a specific assignment, examination, or institution.


16. Free, Pro, and Premium Plans

jamAI may offer subscription levels including:

Free

Pro

Premium

Different plans may include different:

Priority processing; and

Other functionality.

The features and limits displayed when you subscribe form part of the applicable offering.

We may introduce, remove, rename, or modify subscription plans as the Service develops.


17. Paid Subscriptions

Certain functionality may require a paid subscription.

When you purchase a subscription, you agree to pay the price and applicable taxes disclosed to you before completing the purchase.

If a subscription is offered on an automatically renewing basis, the renewal terms, billing frequency, and price will be disclosed during the purchase process.

By purchasing an automatically renewing subscription, you authorize the applicable payment provider to charge the applicable subscription amount at each renewal until cancellation.

You are responsible for maintaining a valid payment method where required.


18. Cancellation

You may cancel an automatically renewing subscription using the cancellation method provided through jamAI or the applicable payment platform.

Cancellation generally prevents future renewal.

Unless otherwise disclosed or required by applicable law, cancellation does not retroactively refund a subscription period that has already been purchased.

You may generally continue using paid features through the end of the paid billing period after cancellation, subject to the applicable subscription terms.

We will not intentionally make cancellation materially more difficult than subscription enrollment.


19. Refunds

Except where otherwise stated during purchase or required by applicable law, payments are non-refundable once the applicable paid subscription period has begun.

We may issue refunds or credits at our discretion.

Nothing in this section limits refund or cancellation rights that cannot legally be waived.

If a subscription is purchased through a third-party platform, refunds may also be subject to that platform’s policies.


20. Changes to Prices and Plans

We may change:

Usage allowances; and

Subscription benefits.

Changes to the price of an existing recurring subscription will take effect in accordance with applicable notice requirements.

If you do not want to continue at a changed price, you may cancel before the new price applies.


21. AI and Resource Usage Limits

AI processing and file processing impose computational and financial costs.

jamAI may therefore impose limits on:

Processing time; and

Other resource-intensive functionality.

Limits may vary by subscription plan.

Attempts to circumvent these restrictions may result in temporary limitations, suspension, or termination.


22. Third-Party Services

jamAI relies on third-party services for portions of its functionality.

These may include providers of:

Analytics; and

Communications.

Current providers include Google, including Google authentication and Gemini AI services, and Supabase for portions of jamAI’s backend infrastructure.

Third-party services may be governed by their own terms and policies.

jamAI is not responsible for independent third-party products or services outside our reasonable control.


23. jamAI Intellectual Property

Except for User Content and third-party materials, jamAI and its licensors retain all rights in the Service.

This includes rights in:

Documentation; and

Other proprietary material.

These Terms do not transfer ownership of jamAI intellectual property to you.

Subject to these Terms, jamAI grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable right to access and use the Service for its intended purposes.


24. AI-Generated Output

Subject to applicable law and third-party rights, jamAI does not claim ownership of output merely because the output was generated for you through jamAI.

However, AI-generated content may not be unique.

Similar or identical content may be generated for:

Other jamAI users;

Users of the underlying AI provider; or

Other services using similar technology.

jamAI therefore does not guarantee that generated output:

Does not resemble existing material; or

Is free from third-party rights.

You are responsible for evaluating whether your intended use of generated output is lawful and appropriate.


25. Feedback

If you voluntarily provide jamAI with:

Product feedback; or

Other feedback,

you grant jamAI permission to use that feedback without restriction or compensation for purposes such as improving and developing the Service.

This does not transfer ownership of unrelated User Content to jamAI.


26. Changes to the Service

jamAI is an evolving product.

We may:

Temporarily suspend functionality; or

Discontinue portions of the Service.

We do not guarantee that every feature will remain available indefinitely.

Where appropriate or required by law, we will provide notice of material changes affecting paid services.


27. Account Suspension and Termination

You may stop using jamAI at any time.

We may suspend, restrict, or terminate your account or access to the Service if we reasonably determine that:

Your account is being used unlawfully; or

Action is reasonably necessary to protect jamAI or other users.

Where reasonable under the circumstances, we may provide notice before termination.

Serious fraud, security threats, unlawful conduct, or urgent risks may result in immediate action.


28. Effect of Termination

After account termination:

Paid features may become unavailable; and

Certain information may be deleted according to our Privacy Policy.

Sections that by their nature should survive termination will continue to apply, including provisions concerning:

Dispute-related provisions; and

Other accrued rights and obligations.


29. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.”

jamAI makes no guarantee that:

The Service will meet every user’s requirements; or

Security incidents will never occur.

Use of jamAI is at your own risk.

Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.


30. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, jamAI AND ITS OWNERS, AFFILIATES, SERVICE PROVIDERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATING TO THE SERVICE OR THESE TERMS.

This may include damages arising from:

Reliance on inaccurate AI-generated information; or

Service interruptions.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF jamAI ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF:

(A) THE AMOUNT YOU PAID TO jamAI DURING THE 12 MONTHS IMMEDIATELY BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR

(B) US $100.

Some jurisdictions do not permit certain exclusions or limitations of liability.

Accordingly, some of these limitations may not apply to you.

Nothing in these Terms excludes or limits liability where doing so is prohibited by applicable law.


31. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless jamAI and its owners, affiliates, employees, contractors, and agents from claims, liabilities, damages, losses, and reasonable expenses arising from:

Your violation of another person’s legal rights; or

Your material violation of these Terms.

This provision does not require you to indemnify jamAI for conduct for which liability cannot lawfully be transferred to you.


32. Privacy

Our collection and processing of personal information is described in the jamAI Privacy Policy.

Please review the Privacy Policy before using the Service.


33. Changes to These Terms

We may update these Terms as jamAI develops, our business changes, or applicable laws change.

When we update the Terms, we will update the Last Updated date above.

If a change is material, we may provide additional notice through:

The Service;

Email; or

Another appropriate method.

Where applicable law requires affirmative consent to a change, we will request that consent.

If you do not agree to updated Terms, you should stop using the Service before the updated Terms become applicable to you.


34. Governing Law

Until jamAI’s operating legal entity and principal jurisdiction are formally identified in these Terms, applicable governing law will be determined according to applicable law and conflict-of-laws principles.

Once jamAI operates through a specified legal entity, this section may be updated to identify the governing jurisdiction.

Nothing in these Terms deprives consumers of mandatory protections that cannot legally be waived under the laws applicable to them.


35. Dispute Resolution

Before initiating formal legal proceedings, you and jamAI are encouraged to attempt to resolve disputes informally.

Nothing in this section prevents either party from seeking relief where immediate legal action is appropriate or required.

Additional dispute-resolution provisions may be adopted after jamAI’s operating legal entity and jurisdiction are formally established.


36. Severability

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent legally permitted or severed if necessary.

The remaining provisions will remain in effect.


37. No Waiver

If jamAI does not enforce a provision of these Terms immediately, that does not waive our right to enforce it later.

A waiver on one occasion does not constitute a waiver on another occasion.


38. Assignment

You may not transfer or assign your rights or obligations under these Terms without jamAI’s permission.

jamAI may assign these Terms in connection with a merger, acquisition, restructuring, sale of assets, financing, or similar business transaction, subject to applicable law.


39. Entire Agreement

These Terms, together with the Privacy Policy and any additional terms presented to you for particular features or purchases, constitute the agreement between you and jamAI concerning your use of the Service.
